Tax Foreclosure Notices, sales scheduled for May 6, 2011

    Beaufort County's first round of tax-foreclosure notices were made available this week. Initially, there were a total of 18 properties scheduled to be auctioned at the Beaufort County Courthouse steps on May 6 at noon; but the delinquent property taxes on one of the parcels have since been paid, removing that property from the list. Therefore, to date, there are 17-total properties scheduled for tax-foreclosure sales in Beaufort County on May 6.

    A tax foreclosure can occur when a real-property owner becomes so delinquent in paying their property taxes that the government places a lien on the property, and then enforces that lien by selling the property to the last and highest bidder. The starting bid includes the property taxes, special assessments of all local governments party to the action (plus interest), and the costs of the foreclosure. On the day the successful bid is confirmed, the successful bidder is required to pay a cash deposit of 20 percent of the winning bid. Before the sale is confirmed, the successful bidder must pay the balance of the purchase price, the recording fees and revenue stamps.

    At any time before a judge confirms a sale, the taxpayer may redeem their property by paying the taxes owed, the attorney fees and suit costs. On the other hand, after the sale is confirmed, the taxpayer has no right of redemption.

    Because local governments are so dependent on the collection of property taxes for survival, the North Carolina Machinery Act stipulates that property-tax liens are superior to all other liens--even mortgage liens. To illustrate, if a tax foreclosure is sold at $10,000, all obligations included in the tax lien are paid first, and the remainder of the proceeds, if there are any, are then disbursed among junior lienholders. Even if a lender is owed $100,000, it may receive only $2,000, or nothing, before its rights are removed from the property. For this reason, if a property up for tax foreclosure is mortgaged, the connected lender will almost always attempt to win the bid, so as not to lose the property for next to nothing.
